Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

• Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
• Country refers to: Ahilyanagar, Maharashtra, India
• Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to MockVest.
• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Service refers to the MockVest website, mobile application(s), and any related services, features, or platforms operated by the Company.
• Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
• Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
• Website refers to MockVest, accessible from https://mockvest.in/
• Application means the MockVest mobile application
  made available on supported mobile platforms.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

Acceptance of Terms

You must be at least 18 years old (or the legal age in your jurisdiction) to use the Service. By creating an account or using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

Geographic Scope of the Service

MockVest is intended solely for users located in India.

We do not represent that the Service is appropriate, lawful, or available for use in jurisdictions outside India. If you access the Service from outside India, you do so on your own initiative and are solely responsible for compliance with local laws.

We do not represent that the Service complies with laws or regulations outside India, and we expressly disclaim any obligation to comply with foreign laws unless required under applicable Indian law.

No Investment Advice

MockVest is not a SEBI-registered entity. The Service does not provide investment advice, stock recommendations, or personalized financial guidance.

All information, analytics, and insights are purely educational and descriptive, based on simulated user activity. Users should not treat any output from the Service as financial advice.

Account Ownership & Transfer Ban

Users may not sell, rent, lease, transfer, or assign their account to any third party. Accounts are personal and non-transferable.

The Service — What It Is

The Service provides simulated trading, educational content, portfolio tracking, market data, charts and related features that allow users to buy, sell, and manage virtual (simulated) shares and instruments using using simulated or virtual currency (collectively, “Simulated Trading Features”).

Key points:

Simulated trades are for educational, informational, and entertainment purposes only.

No real funds are used and no real financial transactions occur through the Service unless we explicitly provide a separate, opt-in live-broker integration and you complete any required agreements with that third party.

Market data and prices shown in the Service may be delayed, aggregated, incomplete, or otherwise not reflective of real-time market conditions.

Not all stocks, instruments, or exchanges are available on the Service; availability is subject to change.

Simulated Funds, Orders & Market Behaviour

Orders placed via the Simulated Trading Features are simulated and are not transmitted to any real exchange or broker unless explicitly stated.

Simulated executions do not replicate real-world factors such as market liquidity, slippage, bid/ask spreads, commissions, taxes, margin requirements, partial fills, or execution latency.

Results on the Service may not predict or reflect real trading outcomes. Any similarity between simulated performance and real performance is coincidental.

Market Data & Accuracy

We may provide market data, quotes, news, charts, or analytics from third-party providers. Data may be delayed, inaccurate, incomplete, or contain errors.

We do not guarantee the accuracy, timeliness, completeness, or fitness for any purpose of market data. You should not rely solely on data from the Service when making real investment decisions.

5. User Conduct & Prohibited Actions

You agree not to:

Use the Service for unlawful activities or in violation of applicable laws or regulations.

Attempt to access, harvest, scrape, or otherwise obtain data from the Service except through features we expressly provide.

Attempt to manipulate leaderboards, rankings, or simulated markets through fraudulent means (including creating multiple accounts to manipulate outcomes).

Reverse-engineer, decompile, or attempt to circumvent security features of the Service.

Use automated scripts, bots, or other systems to interact with the Service unless expressly permitted.

Impersonate another person or misrepresent your affiliation with a person or entity.

Use the Service to promote or facilitate trading in real accounts or to solicit investments from other users without appropriate licensing.

We may suspend or terminate accounts that engage in prohibited conduct.

6. Account Registration & Security

To access certain features of the Service, you must create an account using a valid email address and accurate personal information. You agree to provide true, current, and complete details during registration and to update them as necessary.

Email verification is mandatory for account activation. We require users to verify their email address to prevent fake registrations, spam accounts, fraud, hacking attempts, and automated attacks that could compromise the security and stability of our servers.

Accounts that remain unverified for more than 7 days after registration will be automatically deleted. Once deleted, your data and simulated portfolio activity may not be recoverable.

You are responsible for maintaining the confidentiality of your login credentials and for all activities performed under your account. If you suspect any unauthorized access or activity, you must notify us immediately.

We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion if we believe they violate our Terms, pose a security risk, or remain inactive or unverified beyond the permitted period.

Use of Mobile Application

If you access the Service through our mobile application, you acknowledge that additional permissions may be required for app functionality, such as network access, notifications, or device diagnostics.

We may collect limited technical information such as device type, operating system version, app version, and crash logs to improve performance, security, and reliability of the Application.

Notifications

The Application may send service-related notifications, including security alerts, account activity updates, or important changes. You may control notification permissions through your device settings.

Fees, Payments & Subscriptions

Unless explicitly stated otherwise, the Service may include free and paid features. Any paid subscriptions, fees, or premium features will be clearly disclosed within the Service and require your explicit consent before purchase.

Payments, if applicable, may be processed through third-party platforms (such as app stores or payment gateways). All fees are non-refundable except where required by applicable law or expressly stated at the time of purchase.

8. Intellectual Property

All content, software, designs, trademarks, logos, and other materials on the Service are owned or licensed by us. You may not copy, distribute, create derivative works from, or otherwise exploit our intellectual property except as permitted by us in writing.

By submitting content (comments, tutorials, feedback), you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, modify, and display that content in connection with the Service.

9. User-Generated Content & Community Features

The Service may permit user-generated content (UGC) such as comments, posts, and simulated portfolios. UGC reflects the views of its authors, not necessarily ours.

We reserve the right (but not the obligation) to monitor, edit, or remove UGC that violates these Terms or is otherwise objectionable.

10. Integrations & Third-Party Services

If you choose to link or integrate third-party accounts (social logins, brokerages, analytics tools), you authorize us to access data from those services as permitted by the provider and your consent.

Third-party integrations are subject to their own terms and privacy policies; we are not responsible for their actions or data handling.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

NOTHING IN THESE TERMS CREATES A FIDUCIARY RELATIONSHIP BETWEEN YOU AND US.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR USE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR FIVE THOUSAND INR.

If local law prohibits certain liability limits these will apply only as permitted by law.

13. Indemnification

You agree to indemnify and hold harmless us and our affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of:

your violation of these Terms,

your use of the Service,

your breach of any representations or warranties, or

your violation of any third-party rights.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and store information. By using the Service you consent to our data practices described in the Privacy Policy.

15. Modifications to Service & Terms

We may modify, suspend, or discontinue the Service (or any feature) at any time without notice.

We may update these Terms from time to time. If changes are material we will take reasonable steps to notify you (email or prominent notice). Continued use after changes constitutes acceptance of the revised Terms.

16. Termination

We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms or suspected fraudulent activity.

On termination you must stop using the Service. We may retain certain data as required by law or for legitimate business purposes.

18. Severability

If a court finds any provision of these Terms invalid or unenforceable, the remainder of the Terms will remain in effect and the invalid provision will be modified to the minimum extent necessary.

Jurisdiction

Courts located in Ahilyanagar, Maharashtra, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service.

19. Entire Agreement

These Terms (together with the Privacy Policy and any other documents expressly incorporated) constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

App Store Disclaimer

You acknowledge that these Terms are an agreement between you and the Company, and not with any app store provider. App stores are not responsible for the Service, content, or support obligations related to the Application.
